Arbitration Or Mediation? - Union Township Fire/EMS Contract

   I am really confused on some of the issues in Solictior Abrams response to Pam Barkers letter. Since you chose to display it at the top of the News section of the Village website I assume that you want us to read it and as you well know when things like this are read questions and issues will arise. One of these issues is on the first page of the UT defense letter. It states "and the Village determines that the alteration was a material breach of the Fire Agreement. it must, according to the terms of the Fire Agreement, arbitrate the matter through the American Arbitration Association."


   I am having a hard time trying to determine if we are supposed to mediate or arbitrate. You say arbitrate but under section 11. Arbitration it says:


   Did Solicitor Abrams mean to say mediate instead of arbitrate? There is a difference. Now if it was supposed to be mediate which I believe was what should have been said it makes more sense based on what the contract actually says which is as follows:.


   Then if you look at Arbitration it seems to flow much better.


   First you mediate then if you can't reach an agreeable position you go to court and let them decide. Solicitor Abrams pretty much says the same thing in an email used to explain an earlier question about the American Arbitration Association. The email is as follows:




   I think that clears up the wording in both the UT defense letter as well as the wording in the contract. Whew!
